2026 Declaration of Covenants & Restrictions Proposed Amendments


The following PROPOSED amendments will be voted on at the Association’s Annual Meeting/Election on Tuesday, January 20, 2026 at Brainerd Baptist Church - North Georgia, located at 1473 Cloud Springs Road, Rossville, GA 30741.


  • Amendment 1 allows the Dogwood Place THOA Board of Directors to impose fines on members for violations of the Declaration.

  • Amendment 2 allows the Dogwood Place THOA Board of Directors to assess a late or delinquency charge not in excess of the greater of $10.00 or 10% of the amount of each assessment or installment thereof not paid when due on (a) general assessments; (b) fines; (c) late fees; and (d) all other charges lawfully due under the Declaration.

  • Amendment 3 clarifies lien and foreclosure procedures for charges lawfully due under the Declaration.

  • Amendment 4 clarifies a member’s responsibilities for maintaining tree rings and flower beds.

  • Amendment 5 lists specific requirements for driveway additions and grandfathers existing driveway additions.

  • Amendment 6 increases the monthly assessment by $10 effective January 1, 2027.

  • Amendment 7 changes the quorum to the presence in person or by proxy at any meeting of the Association of one-fourth (1/4) of the Owners of Lots.

  • Amendment 8 clarifies the rights and restrictions of vehicles within Dogwood Place THOA.

  • Amendment 9 clarifies the rights and responsibilities of pets and pet owners within Dogwood Place THOA.

  • Amendment 10 places specific requirements on how many units can be rented concurrently in Dogwood Place THOA while grandfathering all existing rentals from this requirement.

  • Amendment 11 extends the covenants and conditions of this Declaration for 20 years from the date of filing this amendment with the clerk of the Catoosa County Superior Court.

  • Amendment 12 clarifies Association membership and voting rights.
